Important: Please read these Terms and Conditions carefully before using JsonCut's services. By accessing or using our API, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the JsonCut service ("Service") operated by JsonCut ("us", "we", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Description of Service
JsonCut provides an API service that converts JSON configurations into images and videos. Our Service includes:
- RESTful API for image and video generation
- Web dashboard for account management
- Documentation and examples
- Support services
3. User Accounts
3.1 Account Creation
To use our Service, you must create an account. You are responsible for:
- Providing accurate and complete information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
3.2 Eligibility
By creating an account or using the Service, you represent and warrant that you have the authority and legal capacity to enter into these Terms on your own behalf or on behalf of an entity you represent. If you are under the age of majority in your jurisdiction, a parent, legal guardian, or authorized organization must review and accept these Terms and is responsible for your use of the Service.
4. Acceptable Use Policy
4.1 Permitted Uses
You may use our Service for lawful purposes only, including:
- Creating images and videos for legitimate business purposes
- Automating content creation workflows
- Integrating with your applications and services
- Educational and research purposes
4.2 Prohibited Uses
You agree not to use our Service for, or upload to the Service, any of the following:
- Any activity that violates applicable law or regulation in any jurisdiction where you or we operate
- Content that infringes, misappropriates, or violates any third party’s intellectual property, privacy, or publicity rights
- Sexual or exploitative content involving minors; sexualization of minors; grooming; or any content that would constitute child sexual abuse material (CSAM)
- Extremist, terrorist, or violent content intended to radicalize, praise, or provide operational guidance
- Hate speech or content that promotes discrimination or violence based on protected characteristics
- Harassment, doxxing, invasion of privacy, or content intended to threaten or intimidate individuals
- Malware, malicious code, viruses, spyware, or attempts to probe, scan, or test vulnerabilities of our systems or third-party systems
- Illegal or regulated content uploaded without authorization, including but not limited to: pirated media, confidential or classified information, personal data without a lawful basis, medical records, financial account numbers, or other sensitive identifiers
- Sexually explicit or pornographic material where prohibited by law, or content that violates platform/community standards for intended distribution channels
- Instructional content that meaningfully facilitates wrongdoing (e.g., creating explosives, serious harm, or illegal activities)
- Media or files that you do not have the necessary rights or permissions to use, process, or distribute
- Reselling, sublicensing, or redistributing our Service or outputs in a way that competes with JsonCut, except as expressly permitted in writing
5. API Usage and Limits
5.1 Rate Limits
Our Service includes rate limits to ensure fair usage:
- Free tier: 5,000 tokens per month
- API requests: 100 requests per 15-minute window
- Concurrent jobs: Up to 5 simultaneous processing jobs
5.2 Token System
Our Service uses a token-based pricing system where different operations consume different amounts of tokens based on complexity and resource usage.
5.3 Fair Use
We reserve the right to modify rate limits or suspend accounts that abuse our Service or violate these Terms.
6. Content and Intellectual Property
6.1 Your Content
You retain ownership of any content you provide to our Service. By using our Service, you grant us a limited license to process your content solely for the purpose of providing the Service.
6.2 Generated Content
You own the rights to images and videos generated using our Service, subject to compliance with these Terms and applicable laws.
6.3 Our Intellectual Property
The Service, including its design, functionality, and underlying technology, is owned by JsonCut and protected by intellectual property laws.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Service Availability
8.1 Uptime
We strive to maintain high service availability but cannot guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability.
8.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our Service at any time with reasonable notice.
9. Payment Terms
9.1 Free Service
Our Service includes a free tier with limited usage. Additional usage may require payment as specified in our pricing documentation.
9.2 Paid Services
If you choose to use paid services, payment terms will be specified separately. All fees are non-refundable unless otherwise stated.
10. Disclaimers and Limitations
10.1 Service Disclaimer
Our Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2 Limitation of Liability
To the maximum extent permitted by law, JsonCut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
10.3 Maximum Liability
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless JsonCut and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting us or using account deletion features in our dashboard.
12.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, for any reason, including violation of these Terms.
12.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable period.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the German Arbitration Institute.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and JsonCut regarding the use of our Service.
17. File Storage, Processing, and Data Handling
17.1 Uploaded Files
You may upload source files (e.g., images, videos, audio, fonts) for processing. You represent and warrant that you have all necessary rights and licenses to upload and process such files. Do not upload files that are illegal, infringing, or violate these Terms.
17.2 Storage Duration
Uploaded files are stored on our servers for a maximum of 24 hours after upload. After this period, all uploaded files are automatically deleted from our systems. You can also manually delete your uploaded files at any time through our dashboard interface.
17.3 Temporary Processing Files
To generate images and videos, the Service may create temporary intermediary files (including but not limited to transcoded segments, thumbnails, waveform caches, and render artifacts). These files are used solely to complete processing jobs and are automatically deleted after processing completes or after a short retention window necessary for reliability and troubleshooting.
17.4 Data Usage and Privacy
We do not share, sell, or use your uploaded files or generated content for any purposes other than providing the Service. Your files are processed solely for the purpose of generating your requested images and videos. We do not use your content for training, marketing, or any other commercial purposes.
17.5 Generated Outputs
Generated images and videos may be retained according to your account settings and our operational needs. You can download and manage your generated content through our dashboard. We may retain logs and minimal metadata for security, abuse prevention, accounting, and legal compliance purposes as described in our Privacy Policy.
18. User Responsibilities
18.1 Content Creation
You may create a wide range of images and videos using the Service, subject to these Terms. You must not use the Service to create, upload, or distribute any prohibited content as outlined in Section 4.2.
18.2 File Management
You are responsible for managing your uploaded files and generated content. While we provide automatic deletion after 24 hours, you should download and backup your generated content promptly. We are not responsible for any loss of content due to automatic deletion or system failures.
18.3 Fair Use
We monitor your usage of our Service and reserve the right to suspend or restrict accounts that abuse our Service or violate fair use policies. Examples of abuse include: creating multiple accounts to circumvent rate limits, using automated tools to generate excessive content, or attempting to reverse engineer our systems.
19. Moderation, Reporting, and Enforcement
19.1 Abuse Monitoring
We may use automated and manual methods to detect abuse, prohibited content, or violations of these Terms. We may block, remove, or refuse to process content at our discretion.
19.2 Reporting
If you encounter content or behavior that violates these Terms, please report it to support@jsoncut.com. For urgent safety issues (e.g., CSAM), we will report to the appropriate authorities as required by law.
19.3 Enforcement Actions
We may suspend or terminate accounts, restrict access, throttle usage, or remove content to enforce these Terms, comply with legal obligations, or protect the Service and its users.
20. Security and Data Protection
We implement reasonable administrative, technical, and organizational measures designed to protect your content during processing and storage. No method of transmission or storage is 100% secure. You are responsible for maintaining appropriate backups of your inputs and outputs.
21. Export Control and Sanctions
You represent and warrant that you are not located in, under the control of, or a national or resident of any country or region subject to comprehensive sanctions, and that you are not on any restricted party lists. You agree not to use the Service in violation of export control, sanctions, or embargo laws applicable to you or us.
22. Content Ownership and License to Process
You retain ownership of your inputs and generated outputs as described in Section 6. By uploading content, you grant us a limited, non-exclusive license to store, copy, transform, transmit, and otherwise process your content solely for the purpose of providing and improving the Service (including quality, reliability, and safety).
